In a recent move, the Supreme Court of India consented to consider a petition asking for standards to be developed nationwide to provide a safe environment for women, children, and transgender people in the community.
Via the Attorney General’s office, a bench of Justices Surya Kant and Ujjal Bhuyan has sent notice to various Central Ministries and their agencies and scheduled a follow-up hearing.
Senior counsel Mahalakshmi Pawani, who represented the petitioner, the Supreme Court Women Lawyers Association, stated that there are numerous instances of sexual abuse against women that go unreported or are ignored.
Pavani mentioned the unreported rape incidents following the doctor rape case in Kolkata and said that, similar to several Scandinavian nations, such offenders should face harsh punishment.

In response, the Bench stated that while some of the prayers expressed in the petition are “barbari” and “harsh,” and so cannot be addressed, there are other issues that are novel and may be taken into consideration.
Speaking of one such piece of advice, Justice Surya Kant noted that it is crucial to raise awareness about appropriate conduct in buses, metros, trains, and other public transportation since it is one such subject that merits consideration. Publicizing the general dos and don’ts in public utility vehicles is crucial.
“The issue of proper social behaviour in public transport should not only be taught but needs to be implemented strictly as there were some inappropriate incidents reported from airlines also,” the judge said.
The petitioner’s attorney went on to say that even though strict laws and penalties have been determined and numerous guidelines have been issued in various cases throughout the years, are these provisions and guidelines being appropriately implemented?
“We appreciate you seeking relief for the common woman, who faces struggle in day-to-day life,” remarked Justice Surya Kant, acknowledging the petitioner’s efforts.

• The association is requesting through the petition policies, reforms, and actions for women’s protection that can be implemented nationwide.
• The petitioner has demanded that the court use the doctrine of parens patriae to take action to protect the fundamental rights of women, children, and third gender people in the nation. These rights include the right to safety, a secure workplace, adequate sanitation, bodily integrity, personal dignity, and a safe environment in general.
• In conclusion, the petitioner has asked for instructions to guarantee strict legislation, such as the use of chemical castration as a punishment for all convicted sexual offenders and the imposition of lifelong castration on those convicted who have been given life sentences or the death penalty.
• The petitioner has also called for the installation of CCTV in all workplaces and institutions nationwide, the prohibition of unrestricted pornographic content, steps to raise public awareness of the online complaints system, expedited hearings of such cases, provisions to guarantee everyone has access to clean and hygienic restrooms, the hiring of effective security guards, appropriate measures to guarantee safe public transportation, and steps to raise public awareness against victim blaming.
