PIL Against “Operation Sindoor” Trademark Registration at Supreme Court

A PIL submitted to the Supreme Court calls for the prohibition of trademark applications for “Operation Sindoor” from different parties. Following the Pahalgam attack, the Indian Army launched an operation known as “Operation Sindoor,” in which they struck nine bases in Pakistan. On April 22, a terrorist incident in Pahalgam ruthlessly murdered 26 victims.
Dev Ashish Dubey filed the aforementioned petition against four applicants who submitted an Application TM-1 for the registration of the trademark “Operation Sindoor” under Class 41 (education and entertainment industry).
What the Writ Petition Says:-
• According to the plea, private respondents who just want to capitalize on public sentiment for their own financial gain should not be permitted to abuse the name “Operation Sindoor” for commercial gain.
• The petition filed claims that the name “Operation Sindoor” represents the sacrifice made by numerous widows of the soldiers who died defending the nation against terrorism, thereby touching the feelings of the nation’s citizens, particularly those who gave their lives in defense of the nation—not just the soldiers but also their families, as well as the defenseless civilians who were shot down in the Pahalgam terrorist attack on April 22.
• “The Operation Sindoor involves the emotions of not only of the country man but also of those who have sacrificed their life for the country and in the instant killing of innocent civilians in Pahalgam Terror Attack on 22.04.2025 have sparked nationwide outrage,” the petition stated.
• In addition, the petition argued that “the said operation under the Operation Sindoor should not be allowed to be misused for commercial exploitation by the Respondent No. 10 to 14 who only want to take an advantage of the public emotion for their own commercial gain.”
• “Needless to say that even otherwise the registration of the said name under the name and style Operation Sindoor cannot be allowed under Section 9 of the Trademark Act, 1999,” the petition stated.
• Following the filing of the petition and significant public outcry, Reliance Industries withdrew its trademark registration application. The company also provided an explanation, stating that a junior employee had submitted the application without the senior management’s knowledge.
In summary, the petition primarily emphasized that, while Indian forces are working together to carry out Operation Sindoor, with our soldiers at the front line bravely risking their lives for the country, it is important to remember that public sentiment shouldn’t be exploited for profit.
